STORY 16 / Employment & accountable decisions

Buying hiring software does not outsource responsibility.

The Mobley v. Workday proceedings illustrate the legal questions around AI-assisted screening. Allegations and procedural rulings are not findings of discrimination.

Workday disputes the allegations. Preliminary collective certification and surviving a dismissal motion do not establish wrongdoing, a present-day bias rate, or the complete current case outcome.

What the record establishes

The Civil Rights Litigation Clearinghouse records preliminary certification of an age-discrimination collective in Mobley v. Workday on May 16, 2025. Its document index also lists a June 22, 2026 order granting in part and denying in part a dismissal motion.

These developments concern allegations about applicant screening. They are not a finding that the software discriminated, and Workday contests the allegations. The lesson for a buyer is about responsibility and evaluation, not a shortcut to declaring a vendor guilty.

Keep consequential employment decisions human-led

Organizations need processes that account for relevant law, accessibility, validation, and review. An AI-generated rationale can look orderly without establishing that the underlying decision is fair, lawful, or appropriate.

  • Define the limited administrative task the tool is allowed to perform.
  • Review job-related criteria and accessibility with qualified people.
  • Do not infer sensitive characteristics or delegate final hiring decisions to an unsupervised assistant.

A PRACTICAL THADDEUS WORKFLOW

Support the hiring process without becoming the decision-maker.

Use plans and Collab for administrative coordination, consistent interview materials, and a record of human review. Keep the assignment separate from ranking real applicants, inferring protected characteristics, or making employment decisions.

Try this assignment

Prepare an interview-process checklist from this approved role description and our policies. Flag ambiguous criteria and accessibility questions for HR review. Do not score applicants, infer sensitive characteristics, or recommend hiring decisions.

Thaddeus is not presented as bias-free, legally compliant hiring software, or an autonomous employment decision-maker. Legal and validation responsibilities remain with the organization.
